1. Acceptance

Welcome to Pixomax Studio (the “Service”). These Terms form a binding agreement between you and the operator of the Service (“we,” “us”). By accessing or using our website, batch tools, user console, APIs, or related features, you confirm that you have read and agree to these Terms and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of the Service

The Service provides AI-powered photo colorization, preview and download, batch processing, account and credit or subscription management, and developer API access. Features, quotas, limits, and availability may change with product updates; we will provide notice on the website or in the console where reasonable.

We may offer free trials, pay-as-you-go credits, or subscriptions. Fair-use or daily limits may apply to anonymous or signed-out use to prevent abuse.

3. Accounts and credentials

• You must provide accurate registration information and safeguard your account password and API keys. You are responsible for losses due to inadequate protection.
• You must not share your account or API keys with others to evade usage limits. We may suspend or terminate access if we detect misuse to protect the Service and other users.
• You may request account deletion as described in the Privacy Policy; some data will be deleted or anonymized thereafter as required by law and policy.

4. Acceptable use

You agree not to use the Service to, including but not limited to:

• Upload or generate illegal, infringing, obscene, defamatory, hateful, or privacy-violating content;
• Process others’ likenesses or copyrighted works without authorization for infringing commercial use;
• Reverse engineer, bypass authentication, scrape at scale, or otherwise disrupt the Service or its infrastructure;
• Abuse automation to exhaust free quotas, attack endpoints, or degrade service for others;
• Violate applicable laws in your location or where the Service is provided.

We may warn, throttle, suspend accounts, terminate access, or cooperate with law enforcement where appropriate.

5. Credits, plans, and payments

Credit balances, plan names, prices, validity, and refund rules are as shown at checkout or in your order confirmation. Except where required by law or expressly stated by us, consumed credits or elapsed subscription periods are generally non-refundable. Payments are processed by third-party providers; you agree to their terms as well.

6. Intellectual property

You retain your rights in materials you upload. To the extent permitted by law, you receive a license to use output files from the Service for lawful commercial or non-commercial purposes. Software, interfaces, trademarks, and documentation of the Service remain owned by us or our licensors and may not be copied or redistributed without permission.

7. AI outputs and disclaimers

AI-generated results may be imperfect or unsuitable for some use cases. The Service is provided on an “as is” and “as available” basis without warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability. You are responsible for determining whether outputs meet professional or regulatory requirements (e.g. medical, legal, or financial contexts).

8. Limitation of liability

To the maximum extent permitted by law, we and our affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for claims arising from the Service is limited to the amount you paid us for the specific transaction giving rise to the claim in the twelve (12) months before the claim (or, if you only use free services, to zero or the minimum amount permitted by law). Nothing in these Terms excludes liability that cannot be excluded by law, such as for death or personal injury caused by gross negligence or willful misconduct where applicable.

9. Suspension and termination

You may stop using the Service at any time. We may modify, suspend, or terminate features with or without notice for maintenance, compliance, breach, or business reasons. Provisions that by their nature should survive (including intellectual property and limitation of liability) will survive termination.

10. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the Service operator is established, excluding conflict-of-law rules. Disputes shall be submitted to the courts of competent jurisdiction in that jurisdiction, unless mandatory applicable law requires otherwise or a different forum is agreed in writing.

11. Changes to these Terms

We may revise these Terms periodically. Updates will be posted on this page with a new “Last updated” date. If a change materially affects your rights, we will provide notice in a reasonable manner. Continued use after the effective date constitutes acceptance.
